High courts back Skechers in battle against counterfeiters

Khaitan & Co has assisted Skechers South Asia in the American shoe giant’s continuing efforts to combat the widespread sale of counterfeit goods in India bearing the company’s trademarks.

Senior counsel Chander Lall alongside Khaitan & Co’s legal team, led by partners Smriti Yadav and Nirupam Lodha, represented Skechers South Asia. Principal associate Kshitij Parashar, and senior associates Shubham Shende and Gautam Wadhwa also assisted the team.

On 28 April 2025, Skechers secured relief from Delhi High Court, granting the company permission to conduct raids. The search and seizure operations on 3 May 2025 were completed in six locations and led to the confiscation of more than 1,800 counterfeit shoes, along with packaging materials, raw components and printing blocks bearing the Skechers trademarks. These raids follow earlier search and seizure operations in 2024.

On 25 October 2024 in the case of Skechers South Asia Pvt Ltd v Delhi Polymer (2024), Delhi High Court granted Skechers a John Doe order, enabling the company to conduct search and seizure operations. Subsequently, Skechers and the Khaitan & Co team, with support from the police and local commissioners, carried out successful operations the following day.

In the Skechers South Asia Pvt Ltd v Wardrode (2024) case in the Bombay High Court, Skechers secured an ex-parte interim injunction against the defendants. To enforce the court’s order, court-appointed receivers, with local police assistance, carried out search-and-seizure operations at the defendants’ premises in Nashik, Indore and Delhi. This led to the confiscation of around 2,500 counterfeit products, along with packaging materials, printing equipment, and other tools used in their production.

After extensive surveillance, Skechers uncovered additional manufacturers and wholesalers involved in counterfeiting the Amercian company’s shoes. These illegal activities were misleading consumers and damaging the reputation of the Skechers brand.
