Prepayment fees for home loans not a violation

Do banks that levy penalties on prepayment of home loans violate provisions of the Competition Act, 2002? In Neeraj Malhotra v Deustche Post Bank Home Finance Ltd & Ors, the Competition Commission of India (CCI) examined the home loan environment in India and the macro-economic context of the banking sector before deciding that banks and housing finance companies do not violate section 3 and 4 of the act. These sections relate to anti-competitive practices and abuse of dominant position.

In this case, Neeraj Malhotra filed a complaint under section 19(1)(a) of the act against four banking and non-banking financial companies: Deutsche Bank, HDFC, HDFC Bank and LIC Housing. In it he alleged anti-competitive practices, by which the banks imposed prepayment penalty charges, ranging from 1 to 4%, for the prepayment of housing loans.

After the CCI found a prima facie case against the four banks, the CCI asked its investigations wing to initiate a probe. The Director General (Investigation) later expanded the scope of inquiry to 16 home loan providers and held the banks to have violated section 3(3) of the Competition Act as they entered into an anti-competitive agreement under the broad platform of Indian Bankers Association to levy this penalty.

This judgment assumes added significance as it is believed to be the first order passed by the CCI. The CCI neither found any contravention of section 3 or section 4 of the act nor any evidence of an appreciable adverse effect on competition in 含羞草社区 home loan market. The proceedings initiated against the 16 banks were directed to be closed and so cleared them of allegations of having acted as a cartel to fix penalties for homeowners prepaying housing loans.
