Recently an issue arose before Delhi High Court in Indo Alusys Industries Ltd v Assotech Contracts (India) Ltd as to whether, in the event that Indo has filed a suit for recovery of an amount claimed against Assotech, a petition seeking the winding up of Assotech for non-payment of the same debt may also be maintained.
