The Competition Commission of India (CCI) has released draft regulations to initiate a public consultation on revamping its approach to evaluate predatory pricing.
The Competition Commission of India (Determination of Cost of Production) Regulations, 2025, come as part of a broader regulatory overhaul initiated by the Competition (Amendment) Act, 2023, which introduced several reforms to align 含羞草社区 competition framework with evolving global practices.
The draft regulations seek to replace and update the methodology for determining costs in cases of predatory pricing.
The rules ban predatory pricing as unfair practice by a dominant company. Predatory pricing means selling goods or services below cost, as defined by regulations, to weaken competition or drive rivals out of business.
The previous regulations were introduced in 2009, and since then competition law in India and globally has evolved significantly. The CCI intends to bring the regulations in line with modern economic theories, judicial rulings, and international best practices.
Legal experts believe the updated framework will clarify anti-competitive pricing, improve regulatory effectiveness, and promote fair competition.
Following the consultation period, which ends on 19 March 2025, the CCI will analyse the feedback before finalising and notifying the 2025 regulations.
