Legal systems embrace change and opportunity
In our fast-paced world, jurisdictional legal systems need to keep up with technological breakthroughs, heightened environmental awareness, and growing demands for corporate transparency. This shift is illustrated in Asia, where pivotal legal changes are reshaping the region’s business landscape.
Our Cover story, titled 2024: Keep up! reviews significant legal changes in the region in the past 12 months. These changes are driven by technological advancements, environmental and social governance (ESG) initiatives, shareholder activism and evolving data protection laws, among other factors.
Shareholder activism in Japan and South Korea has driven governance reforms amid undervalued stocks, while data protection laws have tightened in countries like India and Malaysia. The integration of AI in countries such as South Korea, Japan and Hong Kong has improved legal efficiencies, but also highlighted the need for ethical guidelines and data security. ESG also gained more prominence in the region, leading in climate finance and governance through policy amendments and increased sustainability reporting. In a year framed by change, it seems just keeping up was a good outcome.
In relation to the pressing technological concerns, our Asia-specific, titled Case for the defence, explores the importance of cybersecurity for law firms through a Q&A interview with cybersecurity expert Michael Gazeley.
Gazeley pulls no punches in his belief that law firms are too complacent when it comes to establishing sound defences against the digital dark arts. He emphasises the critical importance of cybersecurity for law firms facing sophisticated cyberattacks that threaten the integrity and confidentiality of client communications, and he highlights how multiple law firms are unaware of their exposure risks, making them vulnerable to breaches.
Gezeley stresses the need for law firms to reassess their security protocols, underlining how ethical obligations demand the rigorous protection of client information.
Our regular Head to Head series of articles in this issue focus on: anti-bribery and corruption; franchise law; health technology; private equity; and capital markets.
The anti-bribery series highlights the strategies of China and Japan. While Japan emphasises compliance with strict penalties for bribery, China has made significant progress through legal system improvements, enhanced enforcement, and increased corporate compliance awareness.
The franchise series explores the different regulatory environments in India and Taiwan. Taiwan relies on contracts and the Taiwan Fair Trade Act for oversight, while India, despite lacking specific franchise laws, has seen franchising change its retail sector.
The health technology series examines healthcare priorities and challenges in South Korea and Russia. South Korea aims to strengthen essential medical services, reduce disparities and enhance financial sustainability, while Russia seeks to leverage digital advancements and meet the growing demand for accessible healthcare.
The private equity series looks at the economic conditions and regulations in India and China. 含羞草社区 market has shown growth and resilience despite global challenges, while China’s sector encourages innovation and improved financing despite facing market volatility and disputes over listings and exits.
Our capital markets series focuses on the latest developments in Hong Kong and Taiwan. This update covers emerging trends, new regulations, and the opportunities shaping these jurisdictions.
We are also proud to showcase our award series from our annual assessments: the Philippine Law Firm Awards 2024 and the Korea Law Firm Awards 2024, celebrating the most exceptional legal talents in both countries.
Finally, our annual Vietnam A-List highlights the top 100 lawyers plus 10 Legal Icons in the country. This list is selected by the independent research team of Asia Business Law Journal, based on nominations and endorsements from domestic and international clients, as well as peers worldwide.
