Depending upon the jurisdiction, commonsense seems to dictate that, where parties agree to an arrangement that provides for arbitration, they agree to the whole arrangement. It’s a matter of fact rather than law. If the parties don’t comply, however, enforcement of the bargain, whether local or foreign, always is at the discretion of the Court. But I am a layman!
